The UK family courts are facing an unprecedented workload, leaving many individuals frustrated with delays, costs, and the emotional strain of litigation. In response, the government has taken steps to encourage families to resolve disputes outside of court wherever possible. As of 29th April 2024, significant updates to the Family Procedure Rules (FPR) have been introduced, placing greater emphasis on non-court dispute resolution (NCDR).

Why Non-Court Dispute Resolution?

Non-court dispute resolution (NCDR) offers families a more amicable, cost-effective, and time-efficient way to address disagreements. Instead of relying on the courts to dictate the terms of a settlement, families retain control over decisions that impact their future.

The updated FPR now require parties to actively explore and engage with NCDR before submitting disputes to the court. These measures reflect the growing recognition that NCDR can result in better outcomes for all parties involved, particularly when children are at the heart of the dispute.

What Are the Options for NCDR?

Under the new rules, several forms of NCDR are available, allowing parties to choose the most suitable approach for their unique circumstances:

  1. Mediation: A neutral mediator facilitates open discussions, helping parties reach a mutually acceptable solution without taking sides. Mediation is particularly effective in disputes involving children or ongoing co-parenting relationships.

  1. Arbitration: A private arbitrator acts as a decision-maker, reviewing evidence and arguments before making a legally binding decision. Arbitration can be quicker and less formal than court proceedings.

  1. Round Table Discussions: In this approach, parties and their solicitors meet to negotiate a settlement directly, allowing for a collaborative resolution.

  1. Private FDRs: A financial dispute resolution hearing held outside the court, where a neutral financial expert helps guide parties toward an agreement on financial matters.

The New Procedural Requirements

The updated FPR require parties to complete and submit an FM5 form before initiating court proceedings. This form documents the efforts made to resolve the dispute through NCDR. Where an exception applies—such as cases involving domestic violence, urgent matters, or other specific circumstances—parties must provide evidence explaining why NCDR was not pursued.

The goal of these measures is clear: reduce the burden on the courts while encouraging families to explore less adversarial and more cost-effective ways of resolving disputes.

Why Choose NCDR Over Court?

Engaging in NCDR can provide numerous advantages:

  • Speed: Court proceedings can take months, if not years, to resolve. NCDR methods often lead to faster outcomes.

  • Cost: Litigation can be expensive, but NCDR is often more affordable.

  • Privacy: Unlike court hearings, NCDR methods are conducted in private.

  • Control: Families retain more control over the process and outcomes, rather than leaving decisions in the hands of a judge.
