For years, families going through separation have faced something that should never be part of any child's story: waiting. Waiting for hearings. Waiting for decisions. Waiting for life to settle down again, while proceedings drag on for months, sometimes years, in a system that was never truly built around children.

That is finally beginning to change.

On 17th March 2026, the Government confirmed that Child Focused Courts, formerly known as Pathfinder Courts, will be expanded across the entirety of England and Wales. This is not a minor tweak to the existing system. It is a real shift in how family courts work, and if you are a parent going through a separation right now, it matters for you and your children.

So What Actually Changes?

The biggest change is this: the court process will now focus on your children first, not on the dispute between you and your ex-partner.

In the past, family court proceedings could feel like a battle between two adults, with children caught somewhere in the middle. Under the new approach, the court looks at what your children need, identifies any risks to their welfare early on, and works to reach decisions more quickly, without unnecessary hearings that drag things out.

One of the most significant changes is how often children are actually seen and heard during the process. Under the previous system, just 30% of children were seen by a family court adviser. Under Child Focused Courts, that figure rises to 80%. If your child has worries, fears, or wishes of their own, there is now a much greater chance that someone will sit down with them and listen.

Will It Actually Be Faster?

Yes, and the evidence backs that up. This approach has already been trialled in a number of court areas across England and Wales, including all of Wales, and the results are clear.

Court backlogs halved during the trial period, and cases were resolved up to seven and a half months faster. For a parent trying to rebuild their life, and for a child waiting to know where home is going to be, that is not a small thing. That is months of uncertainty and anxiety that simply do not need to happen.

Sir Andrew McFarlane, President of the Family Division, called the approach "truly groundbreaking" and said it would be a "game changer" for the family justice system, noting that it means "fewer hearings, a better understanding of domestic abuse and less parents returning to court because the arrangements have broken down."

Fewer hearings means less time off work, less stress, and less money spent on a process that goes on longer than it needs to.

What About Domestic Abuse?

If domestic abuse is part of your situation, the new courts are specifically designed to take that seriously from the very beginning.

The model aims to improve coordination between the family court and agencies such as local authorities and the police, particularly when dealing with allegations of domestic abuse and other harms. Rather than waiting for concerns to surface during lengthy proceedings, the court will look for risks early and act on them sooner. You should not have to spend months in a courtroom before someone takes your safety, or your children's safety, seriously.
