From 1 April 2025, the fees for using courts and tribunals in England and Wales are set to rise. These changes, which are still awaiting parliamentary approval, reflect inflation to keep the court system running smoothly.

How Will This Affect Family Law Cases?

Here are some of the main changes you'll see:

  • Divorce Applications: £593 to £612.
  • Financial Settlements (Financial Remedy): £303 to £313.
  • Formalising Agreements (Consent Orders): £58 to £60.
  • Child Arrangement Orders (Section 8 Orders): £255 to £263.
  • General Applications in Ongoing Cases: £184 to £190.

Why Are Fees Increasing?

The increases match the 3.2% inflation rate from March 2023 to March 2024. A few fees will see a larger rise of 13.5% to catch up with past inflation from March 2022. The money from these higher fees will help fund the court service, easing the pressure on taxpayer funds and ensuring court operations remain effective.

Worried About Costs? Help is Available

If you find yourself struggling with these fees, you can apply for help through the "Help with Fees" scheme. This scheme might reduce your fees, either fully or partially, depending on your income and savings. You can apply before paying or up to three months after.

Alternative Options Worth Considering

With the rise in court fees, now might be a good time to think about alternatives like mediation or arbitration. These methods can be quicker, less expensive, and less stressful compared to traditional court cases.
